Centre Coms trademarks and trade dress may not be used in connection with any product or service that is not Centre Coms, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Centre Com. All other trademarks not owned by Centre Com or its subsidiaries that appear on this site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Centre Com or its subsidiaries.

RISK OF LOSS

All items purchased from Centre Com are made pursuant to a shipment contract. This basically means that the risk of loss and title for such items pass to you upon our delivery to the carrier. Customers who elect to have goods delivered to an address whereby the goods may be accepted or signed for by a 3rd party (i.e. workplace, hotel, office building) accept all responsibility for location and recovery of the goods once the carrier has reported delivery to that address.

ORDER CANCELLATIONS

Order cancellations are instantaneous over the telephone, contact only the internet sales manager to ensure an instant cancellation. Any cancellations advised by email must allow 48 hours (excludes non working days) for email processing and cancelling. Goods already shipped before a cancellation request is processed (within 48 hours for email or before telephone advise) can be recalled/returned however courier charges cannot be refunded. Please provide (via email ONLY) your account and bsb details for all prepaid refunds.

MISSED DELIVERIES & REDELIVERIES

At the time of ordering it is possible to change the address to which an order is dispatched. Once an order is on its way our system will email you with the courier name and tracking number. If noone is present at the point of delivery the courier will leave a calling card so you may contact the courier for redelivery or pickup at the depot. If a consignment is returned to us undelivered and requires redelivery OR in the case where the courier requires further payment for a redelivery, Centre Com cannot be responsible for covering these additional charges, and any used freight charges are not refundable.

PRODUCT DESCRIPTIONS

Centre Com and its associates attempt to be as accurate as possible. However, Centre Com does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by Centre Com itself is not as described, your sole remedy is to return it in unused condition.

DISPUTES

Any dispute relating in any way to your visit to Centre Com or to products you purchase through Centre Com shall be submitted to confidential arbitration in Victoria, except that, to the extent you have in any manner violated or threatened to violate Centre Coms intellectual property rights, Centre Com may seek injunctive or other appropriate relief in any state or federal court in the state of Victoria, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrators award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

SITE POLICIES, MODIFICATION, AND SEVERABILITY

DEALER ACCESS TERMS & CONDITIONS

Centre Com allows dealer pricing access to legitimate computer resellers who supply their ABN details. Although all efforts are made to ensure up to the minute dealer pricing, there may be rare circumstances whereby market fluctuations, stock shortages and other unforeseen conditions make supply at the listed dealer price not possible. Similarly, the freight calculation system is primarily designed for retail usage and for bulk purchases or larger orders it may be possible an erroneous costing be given. Under these circumstances Centre Com reserves the right to adjust the order costings for the dealers final approval. It is the dealers responsibility to ensure interoperability and compatibility between components, because dealers combine many of their customers orders into one bulk order it is not possible for us to distinguish incorrectly ordered parts i.e. socket 478 board with socket 775 CPU - these goods may be required for 2 seperate end users. Warranty freight must be covered by dealers both ways. A restocking fee may apply to returned goods dependant on market circumstances and promptness of return. If any of the above dealer terms cannot be accepted it is the dealers obligation to ensure notice is given to the webmaster to remove access to dealer pricing.
